Tenancy Options

Each type of tenancy is associated with different rights and responsibilities:

Co-Tenancy
  • all tenants sign the rental agreement
  • all tenants have the same rights and responsibilities
  • if one tenant ends the tenancy, all tenants must leave or re-negotiate a new  agreement
  • if one tenant is evicted, all tenants may be evicted, unless the landlord chooses to re-negotiate a new agreement with the remaining tenants
  • if a tenant moves out, she/he is still responsible for paying the rent (unless  signed off the agreement)
Tenancy In Common
  • each tenant has a separate rental agreement
  • each tenant is responsible for his/her own rental costs
  • one tenant’s eviction doesn’t affect the other tenant

Occupancy (no signed agreement)

  • occupant has minimal rights and responsibilities
  • if the tenant is evicted, the occupant will be evicted
  • tenant can demand the occupant leave
  • landlord’s approval is required before occupancy
